Read in order, with their times and dates, the records of the case show what came next for a 5-year-old girl hurt that morning.

What happened on March 25, 2025

Querencia Los Cabos is a private development in San José del Cabo, Baja California Sur. At about 10:15 a.m., on Boulevard Querencia, one of its roads, a RAM 700 truck bearing Querencia markings rear-ended a golf cart carrying one adult and three children, and the girl was thrown from the cart. The driver told a state investigator: "I got distracted for a few seconds looking down and could no longer avoid it" (translated from Spanish; the original reads "me distraje unos segundos volteando hacia abajo y ya no pude evadirlo").

She was admitted to Hospital H+ Los Cabos at about 10:40 a.m., accompanied by her father and by the club's doctor. Her discharge order records a score of 9 on the Glasgow Coma Scale, a standard emergency-room measure of a patient's level of consciousness, rising to 14 after initial treatment. Hospital records list head trauma, blunt chest trauma and a pulmonary contusion and laceration, with a guarded prognosis; a CT scan ruled out brain or spinal injury. The on-duty emergency physician at Hospital H+ Los Cabos, interviewed by a state investigator on March 25, 2025, said the injuries "may put her life at risk" (translated from Spanish: "pueden poner en riesgo la vida"). She stayed until March 28, 2025; her care is set out in what happened on March 25, 2025, and what the hospital records show.

The hours after the crash

Police received no report from the scene: according to the police reports, municipal traffic police had no report of the crash when C2, a command and monitoring center, reported it at 12:54 p.m.

The records show that the authorities learned of the accident from the hospital, not from Querencia's staff. The hospital's notice to the state Public Prosecutor's Office (Ministerio Público), the authority that investigates crimes, is timed 12:20 p.m. The hospital also reported the case through C2; according to a standardized police report of March 25, 2025, municipal police responded at 12:54 p.m. and notified the prosecutors' early-attention unit at 2:31 p.m. That unit's notice records that it alerted investigative police at 2:59 p.m.

According to a police report dated March 27, 2025, the development's head of security told a state investigator that a tow truck had taken the truck to a body shop moments after the accident. The records cited do not say who ordered the tow. The truck was inspected on March 26, 2025, at a body shop, not at the scene of the crash. Each step is laid out in how the authorities found out about the accident.

The criminal case, step by step

How the criminal case works in Mexico and its documented steps explains each stage. In this case, the records cited here show:

  • Prosecutors opened an investigation file (carpeta de investigación), the record they build on a case, for unintentional bodily injury, failure to render aid (omisión de auxilio), property damage and failure to file a medical report (omisión de informe médico).
  • On July 15, 2026, court records show, a prosecutor asked a pretrial judge (Juez de Control), who oversees the investigation stage, for an initial hearing (audiencia inicial), where prosecutors may formally bring charges, regarding the driver, the club's doctor and Querencia Construcciones, S. de R.L. de C.V. (a Mexican limited-liability company form, roughly comparable to a U.S. LLC). An initial hearing is not a trial.
  • On July 16, 2026, a court order set that hearing for August 26, 2026.
  • On August 26, 2026, the hearing was postponed to September 30, 2026, after the judge asked the prosecutor for the name of the legal representative of the company under investigation.

What is still open

The case remains open: the records cited here document no hearing at which charges were formally brought. The driver and the club's doctor are under investigation, and the prosecutor's July 15, 2026 request names Querencia Construcciones, S. de R.L. de C.V., along with them, as parties under investigation.
