The Querencia Los Cabos Criminal Case in Mexico, Explained
How Mexico's criminal process works, from prosecutors to the pretrial judge, and the documented steps in the Querencia Los Cabos case since 2025.

The Querencia Los Cabos criminal case is a state prosecutors' investigation and a court case, Criminal Case J410/2026, concerning the accident of March 25, 2025 in San José del Cabo, Mexico, when a RAM 700 truck bearing Querencia markings rear-ended a golf cart and a 5-year-old girl was thrown from it. Court records show that on July 15, 2026, a prosecutor asked a pretrial judge to hold a hearing to formally charge the driver, the club's doctor and Querencia Construcciones, S. de R.L. de C.V. (a Mexican limited-liability company form, roughly comparable to a U.S. LLC). The records cited here document no hearing at which charges were formally brought.
How a criminal case works in Mexico
- Ministerio Público: the state Public Prosecutor's Office, the authority that investigates crimes and decides whether to pursue prosecution. In everyday reporting, these are the prosecutors.
- Carpeta de investigación: the investigation file that prosecutors build as they gather information about a case.
- Juez de Control: a pretrial judge, who oversees the investigation stage.
- Audiencia inicial and formulación de imputación: the initial hearing (audiencia inicial) is where prosecutors may formally bring charges against a person or a company, a step called formulación de imputación. It is not a trial. Until that step, the people and companies involved are under investigation.
- Causa penal: the court case, with its own number, that exists once a judge becomes involved.
In practice, prosecutors investigate, the pretrial judge supervises, and charges become formal only at the initial hearing.
Documented steps in the case
Prosecutors opened an investigation file (carpeta de investigación) for unintentional bodily injury, failure to render aid (omisión de auxilio), property damage and failure to file a medical report (omisión de informe médico). A separate note explains how the authorities found out about the accident.
Court records show that, in an order dated July 16, 2026, in Criminal Case J410/2026, the judge set the hearing requested on July 15 for August 26, 2026. The driver and the club's doctor are under investigation; the records cited here do not document any hearing at which charges were formally brought against any of the three.
On August 26, 2026, the hearing was postponed to September 30, 2026, after the judge asked the prosecutor for the name of the legal representative of the company under investigation.
