A police report records that the truck in the Querencia Los Cabos accident was towed to a body shop. Where and when the truck and the golf cart were inspected.

A gravel road shoulder and desert scrub under a hazy sky in Baja California Sur

On March 25, 2025, a truck bearing Querencia markings rear-ended a golf cart on Boulevard Querencia, inside the Querencia Los Cabos development in San José del Cabo, Mexico, and a 5-year-old girl was thrown from the cart. The truck in the Querencia Los Cabos accident was towed to a body shop, according to a police report dated March 27, 2025: the development's head of security told the officer that "a tow truck took it away moments after the accident" (translated from Spanish). The truck was inspected at a body shop on March 26, 2025, not at the scene.

Where the truck went

According to a police report dated March 27, 2025, the development's head of security told the officer that the RAM 700 truck had been taken to a body shop. The report records that statement in these words: "se la llevó una grúa momentos después del accidente" (translated from Spanish: "a tow truck took it away moments after the accident").

The truck was inspected on March 26, 2025, at a body shop, not at the spot on Boulevard Querencia where the crash occurred. Neither the police report nor any other record cited here says who ordered the tow or for what purpose.

What each inspection recorded

An inspection report (acta de inspección) is the written record investigators make after examining a vehicle or a place. Two such reports cover the vehicles in this crash.

According to the inspection reports, the golf cart was examined at 6:23 p.m. on March 25, 2025, in the club's parking lot, and the impact was at the rear of the cart.

The truck's report is timed 12:26 p.m. on March 26, 2025, and was drawn up at a body shop. It places the impact at the front of the truck and lists the grille, the bumper, the hood and the front frame as damaged.

Where it happened

The development's own website, qcabo.com, consulted on October 8, 2026, lists its location as Fraccionamiento Querencia, Carretera Transpeninsular km 27.5, Palmilla, San José del Cabo, Baja California Sur.

The crash took place on Boulevard Querencia, a road within the development, at about 10:15 a.m. on March 25, 2025. The golf cart, carrying an adult and three children, was struck from behind by the truck.

What the authorities did

In Mexico, state prosecutors (Ministerio Público) are the authority that investigates crimes and decides whether to take a case to a judge. According to a decision dated February 11, 2026, and its authorization, prosecutors at the Baja California Sur State Attorney General's Office resolved not to prosecute (no ejercicio de la acción penal) four parties for failure to render aid (omisión de auxilio), failure to file a medical report (omisión de informe médico) and encubrimiento (concealment), on the ground that the conduct did not fit those offenses (atipicidad). The four were the driver and the club's doctor, both under investigation, and two companies (personas morales), Querencia Real Estate and Querencia Golf Club. The same decision did move to prosecute the driver, for unintentional bodily injury and property damage.

According to the transcription of the ruling, on September 23, 2026, at a hearing to review that decision (audiencia de control), a pretrial judge (Juez de Control), who oversees the investigation stage, revoked the decision, dated February 11, 2026, and authorized on February 13, because it was not grounded or reasoned (no estaba fundada ni motivada), and ordered the investigation to continue. In the same ruling, the judge considered that not prosecuting the companies was warranted.

Article 16 of Mexico's Constitution requires every act of authority to be grounded and reasoned: it must cite the law it relies on and explain how that law fits the facts. Setting aside three offenses, after a 5-year-old girl was thrown from a golf cart, through a decision revoked for meeting neither requirement is not due process; it is an injustice on the part of the authority. That judgment concerns an act of the State Attorney General's Office, not any individual, and everyone named in the decision is presumed innocent.

How the authorities first learned of the crash is laid out in the step-by-step account of how they found out. The morning of March 25, 2025, is reconstructed in what happened in the Querencia Los Cabos accident.
