Is Querencia Los Cabos Safe? What Is on Record About the March 25, 2025 Golf Cart Crash
A golf cart crash inside Querencia Los Cabos on March 25, 2025: how authorities learned of it, what the development's website publishes, what prosecutors did.

In San José del Cabo, in Mexico's Baja California Sur state, a truck bearing Querencia markings hit the back of a golf cart on Boulevard Querencia on the morning of March 25, 2025, and a 5-year-old girl who was in the cart was thrown out of it. According to a statement in the investigation file (carpeta de investigación), she was then struck by Querencia's truck, which weighs more than 500 kilograms (over 1,100 pounds). Whether Querencia Los Cabos is safe is not a question this article answers with a yes or a no; it sets out what the record and the development's own website show, each with its date. As of October 26, 2026, the development's website listed no page on safety, emergencies, medical care or protocols, which reflects the site only, not any procedures the development may have.
What is on record about that morning
The truck struck the cart at about 10:15 a.m. Around 10:40 a.m., she entered Hospital H+ Los Cabos, accompanied, among others, by the club doctor, who is under investigation, according to police records and the early-attention unit's notice.
According to the police report, the municipal traffic police had received nothing about the crash by 12:54 p.m., the time C2, a control and monitoring center, reported it.
Word of the crash reached the authorities through the hospital, not through Querencia's staff. According to a statement in the investigation file, the case file kept by state prosecutors, none of Querencia's staff called 911 or any other emergency service. Each notice that day is traced, with its source, in an earlier report on how the authorities were notified.
What the development's website publishes
Querencia presents itself on the home page of qcabo.com, consulted on October 8, 2026, as "Querencia Private Golf & Beach Club in Los Cabos." That day, the site gave the development's address as Fraccionamiento Querencia, Carretera Transpeninsular km 27.5, Palmilla, San José del Cabo, Baja California Sur (fraccionamiento means residential subdivision). That self-description is the starting point of a separate report on how the development presents itself.
A site map is the file in which a website lists its pages for search engines. As of October 26, 2026, none of the 283 pages in the qcabo.com site map was about safety, emergencies, medical care or protocols; the site offered a "Contact Us" page and general phone numbers. That count describes only what the website publishes, not any procedures the development may have in place.
What Querencia Real Estate told prosecutors
State prosecutors, known in Mexico as the Ministerio Público, are the office that investigates crimes and decides which cases go before a judge. On January 29, 2026, they sent the company Querencia Real Estate a formal written request (oficio), and it answered in writing.
Querencia Real Estate filed that written response on February 4, 2026, almost 11 months after the accident, signed by its attorney, Francisco Javier Troncoso Valle. Among other points, the company's response stated that the golf cart "was rear-ended by the Querencia truck, which caused a minor to be thrown from the golf cart," and that the minor "was taken to a hospital to rule out any injury that could result from the traffic incident" (translated from Spanish).
In the same document, Querencia Real Estate offered the truck for inspection and wrote that it "is in operation within the Querencia development" (translated from Spanish). According to the police report, the head of security at the development informed an investigator that the truck had been taken by a tow truck to a body shop moments after the accident. According to a statement in the investigation file, that transfer "makes it impossible to carry out any further investigative act" (translated from Spanish).
What prosecutors and a pretrial judge did
A decision not to prosecute (no ejercicio de la acción penal) keeps a matter from reaching a judge. According to the decision and its authorization, a prosecutor with the Procuraduría, the Baja California Sur State Attorney General's Office, proposed in a decision dated February 11, 2026, not to prosecute Querencia Real Estate, Querencia Golf Club, the club doctor, José Luis Sánchez Musi, who is under investigation, and the driver, also under investigation, for failure to render aid (omisión de auxilio), failure to file a medical report (omisión de informe médico) and concealment (encubrimiento). Its stated ground was atipicidad: the conduct, it said, did not match how the law defines those offenses. It did seek to prosecute the driver for property damage and unintentional bodily injury.
According to the transcription of the ruling, on September 23, 2026, a pretrial judge (Juez de Control) in Los Cabos, who oversees the investigation stage, revoked that decision, dated February 11, 2026, and authorized on February 13, in a hearing to review it (audiencia de control), because it was not properly grounded or reasoned, and ordered the investigation to continue. In the same ruling, the judge considered that not prosecuting was warranted as to the companies (personas morales). Prosecutors were left free to issue a new decision meeting that standard.
Mexico's Constitution sets the rule in Article 16: an authority that acts has to name the legal basis for the act and explain why it applies, which is what fundar y motivar means. Issuing and authorizing a decision not to prosecute three offenses without meeting that requirement is not due process: it was an injustice, and it came from the State Attorney General's Office.
